These Terms and Conditions govern your use of the Visit My Harbour websites. By accessing or using our services, you agree to be bound by the terms set out below. Please note that all website content is provided for general information only and must not be used for navigation purposes.

By accessing and using the Website, you are deemed to have read, understood, and agreed to be bound by these Terms.

1. Website Use

NOT FOR NAVIGATION PURPOSES: Content on the Website is provided for general information only and must not be used for navigation.

The UK Maritime and Coastguard Agency (MCA) requires that mariners carry up-to-date official charts, tide tables, lists of lights, weather forecast reception equipment, and prepare proper passage plans. Nothing on this Website meets those requirements.

Charts displayed are not to navigation standards, tide tables are approximate, waypoints may be unsuitable, and harbour information may be outdated or inaccurate.

The prudent mariner must use official publications and, if in doubt, stand off in safe deep water.

Note: “Buy and Keep” products sold separately may be used for navigation, as explicitly stated at the point of sale.

2. Disclaimer of Liability

The Website is provided “as is” and at your own risk.

While the Providers strive for accuracy, no warranties (express or implied) are given regarding the accuracy, completeness, or reliability of the content.
You must always rely on official, up-to-date charts and data before making any navigational decisions.

The Providers accept no responsibility for:

  • Any inaccuracies or omissions (except fraudulent misrepresentation).
  • Any loss, damage, cost, or expense incurred through use of, or inability to use, the Website.
  • Technical problems, including viruses or connectivity issues, outside of the Providers’ control.

You are responsible for ensuring your own computer security.

3. User-Generated Content

Comments, posts, or adverts submitted by members remain the responsibility of the author and are not endorsed by the Providers.

The Providers may remove comments or adverts at their discretion, without explanation.

Members must not post defamatory, obscene, racist, inflammatory, or otherwise unlawful material.

Members are liable for their postings and agree to indemnify the Providers against any resulting claims, costs, or legal expenses.

4. Intellectual Property Rights

All intellectual property rights in the Website content are owned by or licensed to the Providers.

Charts, text, and images are for personal use only and may not be copied, published, redistributed, or used commercially without written consent.
Any attempt to copy the Website in bulk, interfere with its operation, or misuse its content will result in liability for costs incurred.

Some material is derived from the UK Hydrographic Office (UKHO), Her Majesty’s Stationery Office, and other authorities listed below, used with permission.

Notice: The UKHO and its licensors make no warranties, express or implied, regarding this product and have not verified its accuracy or quality.

5. Invalidity and Severability

If any provision of these Terms is found unenforceable by a competent court, that provision shall be deleted, and the remainder shall remain valid and enforceable.

6. Third Party Rights

Nothing in these Terms grants any rights under the Contracts (Rights of Third Parties) Act 1999 to persons who are not parties to them.

7. International Use

The Website is intended for users in the United Kingdom. Accessing it from jurisdictions where its content is unlawful is prohibited. If you access the Website from outside the UK, you do so at your own risk and are responsible for compliance with local laws.

8. Matters Beyond Our Control

The Providers shall not be liable for any failure or delay caused by circumstances beyond their reasonable control, including but not limited to natural disasters, war, strikes, government action, or technical network failures.

9. Indemnity

You agree to indemnify the Providers against all claims, proceedings, damages, and costs (including legal fees) arising from your misuse of the Website or breach of these Terms.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. You submit to the non-exclusive jurisdiction of the English courts.
